How do I replace an existing fence?

We recommend that you discuss what type of fence you would like with your neighbour to reach an agreement with them before contacting Formula Fencing to attend your home and discuss your proposed fence.
You should also discuss the removal of any obstructions on the fence or the fence line such as trees or shrubs and any existing fence with your neighbour beforehand. Formula Fencing are happy to remove any obstructions for a fee.
Reaching agreement with your neighbour before obtaining a quote makes the process easier and quicker and less costly for you.

Am I required to pay half the cost of my neighbour’s fence?
The Fences Act 1968 clearly states that adjoining land owners (neighbours), are required to pay half the cost of a standard fence each.
You are not required to pay for anything more than a standard fence, unless you agree to. If your neighbour wishes to have a specific design or extras other than a standard fence, you only need to pay your half share of the standard fence and they are required to pay the difference, unless you agree to share the costs equally.
If you refuse to pay your half share or co-operate with the construction of a standard fence, a Magistrate can make an Order in relation to the construction of the fence and the amount each neighbour is required to pay.
Can I request that the fencer place the “smooth side” of the palings to face me?
You can request this, however, please keep in mind that this may not always be possible as the fencer must place the palings in a specific direction.
Further, if you or your neighbour has a swimming pool the “smooth side” of the fence palings must face away from the pool, to prevent children climbing over the fence into the swimming pool area.
Can my neighbours insist on obtaining another fencing quote?
Yes, they can. It is up to you and your neighbour to reach agreement on which fencing contractor to use after obtaining fencing quotes.
